These Terms and Conditions ("Terms") govern your access to and use of the "Regulars" social app ("App") provided by Regulars - App LLC ("Company," "we," or "us"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please refrain from using the App.

1. App Description and Purpose

Regulars is a social economy platform that connects creators within the service industry with their regular customers, facilitating direct communication and allowing creators to earn additional tips through exceptional service. The App highlights individuals and their services rather than businesses. Users can search for specific service providers such as chefs, musicians, and bartenders to discover and engage with them.

2. User Registration

2.1. To use the App, you must create an account and provide accurate and complete information during the registration process. You must be of legal age as per the laws of your jurisdiction to create an account.

2.2. You are responsible for maintaining the confidentiality of your account credentials and for any activities or actions that occur under your account. Notify us immediately of any unauthorized use of your account or any other breach of security.

3. User Responsibilities

3.1. You agree to use the App in compliance with applicable laws and regulations.

3.2. You are responsible for your interactions and engagements with other users and service providers. We encourage respectful and lawful behavior while using the App.

6.1. You agree not to engage in the following activities while using the App:

6.1.5. Uploading or disseminating malware, viruses, or any other harmful code.

6.1.6. Violating any applicable laws, regulations, or third-party rights.

7.1. The App and all related intellectual property rights are owned by the Company. You agree not to reproduce, modify, distribute, or create derivative works based on the App without our prior written consent.

8. Termination

8.1. We reserve the right to suspend or terminate your access to the App, in whole or in part, at any time and for any reason, including but not limited to:

8.1.1. Violation of these Terms or any applicable laws or regulations.

8.1.2. Engaging in fraudulent or unauthorized activities.

8.1.3. Conducting activities that may harm the reputation or functioning of the App or the Company.

8.1.4. Any other conduct that we deem inappropriate or harmful.

8.2. In the event of termination, your account and access to the App will be deactivated, and you may lose any data or information associated with your account. We shall not be liable to you or any third party for any termination of your access to the App.

8.3. You may also terminate your account and discontinue using the App at any time by contacting us or following the account closure procedure provided within the App.

9. Dispute Resolution

 9.1. Any disputes arising out of or relating to these Terms or your use of the App shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

9.2. Any legal action or proceeding arising out of or relating to these Terms or the App shall be exclusively brought in the state or federal courts located in the State of California, and you consent to the personal jurisdiction and venue of such courts.

10. Liability Limitations

10.1. The App and its content are provided on an "as is" and "as available" basis. We make no warranties, whether express or implied, regarding the accuracy, reliability, or availability of the App.

10.2. To the maximum extent permitted by applicable law, we shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in any way related to your use or inability to use the App, including but not limited to damages for loss of profits, data, or other intangible losses.

11. Updates to Terms and Conditions

11.1. We reserve the right to modify or update these Terms at any time, without prior notice. Any changes to the Terms will be effective upon posting the revised version within the App. It is your responsibility to review these Terms periodically to stay informed of any updates.

11.2. Your continued use of the App after the posting of any changes constitutes your acceptance of such changes.
